PS Focus Terms of Use

By installing or using PS Focus you agree to these terms. If you do not agree, do not install or use it. Nothing in these terms limits the rights the GPL gives you.

1. Licence

PS Focus is free software, released under the GNU General Public License, version 3 (GPL). You may use it for personal or commercial artwork, and copy, change, and share it under the GPL’s terms. The full licence is in “License.txt” in the installation folder, and the source code is at https://github.com/giltyworks/ps-focus.

The GPL covers the code. The PS Focus name and logo are not licensed with it, so if you share a changed version, give it a different name and logo so people can tell it apart from the official app.

3. Third-party components

Third-party components included with PS Focus are provided under their own licences, listed in “Third-Party Notices.txt” in the installation folder. Those licences take precedence for those components.

4. Your data

Your activity history, settings, and backups belong to you. How PS Focus handles them is described in the Privacy Policy (“Privacy Policy.txt” in the installation folder).

5. Google and other services

Google sign-in and Drive backup are optional and are also subject to Google’s own terms. PS Focus is not affiliated with or endorsed by Google, Adobe (Photoshop), Krita, Celsys (Clip Studio Paint), the PhotoCraft project, or Microsoft. Their names are trademarks of their respective owners.

6. Updates

PS Focus may tell you when a new version is available. Updates are optional, and these terms (as updated) apply to them.

7. No warranty

PS Focus is provided “as is” and “as available”, without warranties of any kind, express or implied. These include warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Giltyworks does not guarantee that PS Focus will be error-free or uninterrupted, that time will be recorded accurately, or that backups will always succeed. Keep your own copies of anything important.

8. Limitation of liability

To the fullest extent permitted by law, Giltyworks is not liable for any indirect, incidental, special, consequential, or punitive damages. Nor is it liable for any loss of data, profits, or work, arising from your use of or inability to use PS Focus. Giltyworks’ total liability for any claim relating to PS Focus is limited to the amount you paid for it, which is nothing.

9. Your rights under consumer law

Nothing in these terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, that is implied or imposed by law and cannot lawfully be excluded or limited.

10. Changes to these terms

Giltyworks may update these terms. Updated terms are published with the new effective date and apply to versions released after that date.
